Federal Court of Appeals affirms broken NEB process and failed Indigenous consultation on Kinder Morgan pipeline

The Council of Canadians congratulates Indigenous leadership for an important legal victory against the Kinder Morgan Trans Mountain pipeline and tanker project.

In response to the Federal Court of Appeals decision to quash government approvals to build the contentious pipeline, the Council of Canadians comments:

“This fight was led by First Nations who were not adequately consulted and now the government, if it persists in its flawed support of the Kinder Morgan pipeline, must entirely restart the process of listening to First Nations and respecting consent, including the right to say no,” says Maude Barlow, Honorary Chairperson of the Council of Canadians.

“The Liberal government has bought a $7.4 billion (and rising) pipeline expansion project that will now be forced into years of further review and delay,” adds Andrea Harden-Donahue, Energy and Climate Justice Campaigner with the Council of Canadians. “Prime Minister Trudeau knew the Harper-era NEB process was broken and its band-aid attempts to fix it clearly failed. It is time for real political leadership that truly respects Indigenous rights, does not bow to the interests of Big Oil, and prioritizes all of our interests in setting us on a path to a sustainable economy and environment. It is time to put a stop to the Kinder Morgan buy-out.”
